I think some of these Antivirus vendors are using this issue as a stick to beat Microsoft with because they're worried about Microsoft's entry in to their market with things like OneCare and Forefront! Certainly vendors like Kapersky have said that this isn't a problem at all. Surely Microsoft have the right to protect the kernel in a way that they see fit!
